Wedding Collection Terms & Conditions

Payment
A non-refundable deposit of £250 is required to secure your booking.  The remainder of the balance is payable 28 days prior to the wedding date.  No photographs will be released until payment is received in full. There may be a festive period surcharge applied. Festive period is from 24th December to 1st January inclusive.


Cancellation and changes
Clients are entitled to a full refund of the £250 booking fee within 14 days of booking.  Cancellation less than 12 weeks before the wedding will result in payment in full.  All cancellations must be made in writing.  If the wedding is postponed to a new date, the booking fee may be carried over at the discretion of 5 Little Boys Photography and subject to availability.  In the unlikely event of 5 Little Boys Photography being unable to attend on the day, we reserve the right to appoint another photographer to attend on our behalf to undertake the wedding photography to the best of their ability.  Should a replacement be unavailable, all monies paid will be refunded in full.  In the event of any changes to plans including dates, times and venue, it is the responsibility of the client to notify 5 Little Boys Photography immediately.


Display
5 Little Boys Photography may display any images covered by this contract for promotion in studios, websites (including blogs and social networking sites), portfolio, literature, display areas, exhibitions, competitions, advertising, slide shows or commercially, as long as images are used lawfully and without damage to the client.


Images
All image sizes are nominal.  The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres.  It is sometimes impossible to record digitally the exact colour seen by the human eye.  The photographer will retake a shot if a subject has been seen to blink.  However it is impossible to guarantee to spot every blink, especially in group shots.
The photographer will aim to deliver the images within 12 weeks of the event however this may be longer depending on the time of year & work flow.


Retouching and editing
The photographer may retouch, digitally manipulate and finish according to his/her discretion.  Further retouching, digital manipulation and finishing requested by the client is available as an optional extra and may incur additional charges.

Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of 5 Little Boys Photography.  It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the written permission of 5 Little Boys Photography.  It is understood however, that if a  USB of your images is purchased as part of your contract, the client has the right to reproduce the images for personal use.

 


Licence and coverage
5 Little Boys Photography shall be granted artistic licence in relation to the poses photographed and the locations used.  Photograph location, poses and number of images taken is at the discretion of the photographer.  

The photographer will endeavour to fulfil the requirements of the client.  However due to the unpredictability of factors such as weather, willingness and cooperation of subjects it may be impossible to capture all the images requested.

For bookings involving a church ceremony or at certain other venues, photographers’ movements are sometimes restricted by the minister or official in charge.  Photographing of parts or even all of the ceremony may be restricted or prohibited, as may the use of artificial lighting. The photographer cannot accept responsibility for limited coverage in such cases.

For collections that include a complimentary pre-wedding shoot, this must be taken before the wedding day.

For collections that include albums, the images for the album must be selected within 6 months of receiving the images.


Force majeure, Act of God and limitation of liability
The due performance of the contract is subject to alteration or cancellation by either party owing to any cause beyond their control (e.g. sudden illness, injury).  In the unlikely event of a total photographic failure or cancellation of the contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract.  Neither party shall be liable for indirect or consequential loss.


Digital files
Digital files remain the property of 5 Little Boys Photography.  The photographer will not be solely responsible for the storage and maintenance of digital files, but will keep them intact and available to the client for at least one year from the date of the wedding.

Privacy Policy
It is the responsibility of the client to inform any attendees at the event that there will be a photographer present & the responsibility of the client and/or the attendee to inform the photographer of any issues.

Complaints
Any complaints should be raised by the client in writing to 5 Little Boys Photography within 14 days from receipt of images.
